Smith, Beverley G

July 19, 1930 - August 4, 2017


Bev was born in Saint John, New Brunswick, the son of Williard A. and Marion G. (Gault) Smith on July 19, 1930. He attended primary and secondary schools in Saint John, graduating from the Faculty of Law, University of New Brunswick in 1953. He practiced law in the cities of Fredericton, Saint John and Ottawa, Ontario before joining the legal department of Shell Oil Canada in Calgary, Alberta. Bev married Elizabeth J. Springer in 1959. The couple moved in 1960 to London, Ontario where he practiced with the law firm of Ivey, Livermore and Dowler, later joining R.J. Lamon, Q.C. to form the law firm of Lamon and Smith. In 1973 Bev and Elizabeth returned to New Brunswick where he became Director of Law Reform for the New Brunswick Department of Justice in Fredericton. In 1980 Bev joined the Faculty of Law at the University of New Brunswick in Fredericton, from which he retired in 1996, prior to being appointed Professor Emeritus. He is the author of the legal text, “Professional Conduct for Lawyers and Judges”.

A life long Anglican, Bev served in various capacities, including lay reader, in churches located in the respective communities of residence. He is survived by his wife of 58 years, Elizabeth; three sons, Cameron (Sylvia), James (Anne), and Bruce (Solange); and by several grandchildren.

In lieu of flowers a donation to a charity of choice will be greatly appreciated.

Dear Elizabeth, Cam, Mac, Bruce and Family, Please accept our heartfelt condolences. We will always remember Bev for his tremendous joviality, optimism, grace and love of family. We will cherish the memories of many wonderful visits to the home in Prince William, featuring relaxing swims in the river, delicious bbq’s and enthusiastic sing-alongs after supper with Bev leading us on the piano! Since UNB is near and dear to many of us, his achievements at the university stand out for us in particular, especially being honoured as professor emeritus in 2000 (we were in attendance at the ceremony!) We always looked forward to the thoughtful and witty homemade Christmas cards and frequent phone calls on John’s and Althea’s birthdays. We are so thankful that Warren and John were able to speak with him on his birthday last month, and are honoured that both are his godsons. We have looked up Elizabeth and Bev’s last entry in our guest book and found they were with us at 135 Charing on September 27, 2007. The great times we all shared with him will always live on with all of us, and especially, of course, with all of you. We will remember him as a fine gentleman and a marvelous family member whose example we should all aspire to follow. Our love to you all. John, Rosa, Rachel, Warren, Althea and Family.

My sincere condolences on the loss of Bev. His many students at UNB Law — I was one — both admired and respected him. He is missed and will be missed. I was privileged to have been his colleague for 16 years after I joined the Faculty in 1980.

I will share that Bev once cost me $1000. I had given a litigation tip to a lawyer who was able to it to benefit his client and win a case. He later sent me a cheque for $1000 – a surprise indeed. Hoping I was wrong to feel troubled by the cheque, I went to see Bev (who taught Professional Conduct; that is, ethics). I explained the circumstances and asked if I could keep the cheque. He said “no” so I returned the cheque and did not stray from the straight and narrow ethical path.

He was one of a kind – of whom the world needs so many. Again, my sympathies. John M

i was saddened to read Bev’s obituary in the Record and sorry to reutrn home too late to attend the service. Bev always reached to to me whenever we saw each other at the CV Probus meetings. He was a gracious and wise friend. He loaned me some of his publications. Whenever I drove past Ship’s Point I saluted he and Elizabeth in my mind. I will continue to do so. Farewell to a good man.
